Terms of Service – Amazing Church California App
Welcome to the Amazing Church California App (“the App”), developed and operated by Amazing Church California (“the Church”). By using the App, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before using the App.
1. Acceptance of Terms
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“the Terms”). If you do not agree to these Terms, you must refrain from using the App.
2. User Accounts
a. This is an invitation-only church community. An administrator must invite you before you create an account. Follow the invitation link to set your password, then sign in with the same credentials in the app. Access to individual ministry groups depends on membership and permissions. You must provide accurate account information and keep it up to date. Account holders must be at least 13 years old. Administrators may invite only people aged 13 or older; accounts for children under 13 are not permitted.
b. You are responsible for maintaining the confidentiality of your account credentials, and you agree not to share your account details with any third party. You are fully responsible for all activities that occur under your account.
c. The Church reserves the right to suspend or terminate your account at any time for any reason, including but not limited to a violation of these Terms.
3. User-Generated Content
a. The App allows registered users to post content, such as messages, comments, photos, documents, and links to externally hosted videos (“User Content”). You understand and agree that you are solely responsible for any User Content you post and the consequences of sharing it.
b. By submitting User Content, you grant the Church a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, distribute, modify, adapt, publicly display, and perform the User Content for the purposes of operating and promoting the App.
c. You represent and warrant that you own or have the necessary rights, licenses, permissions, and consents to post and share User Content on the App. You agree not to post any content that infringes upon the rights of others or violates any applicable laws or regulations.
d. Treat other members respectfully. Harassment, threats, abusive or hateful content, sexual exploitation, spam, impersonation, and unlawful content are prohibited. You can report posts or comments and block members through the available community controls. Content matching the community’s profanity filter may be held for administrator review. Administrators may review reports, remove content, or restrict accounts to protect the community. Direct video and audio uploads are not enabled; supported external video embeds may be shared.
4. Intellectual Property Rights
a. All intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, and patents, in the App and its content, are owned by or licensed to the Church. You agree not to reproduce, modify, distribute, or create derivative works based on the App or its content without the Church’s prior written permission.
b. You may submit suggestions, feedback, or ideas regarding the App to the Church. By doing so, you grant the Church the right to use and incorporate such suggestions, feedback, or ideas into the App without any obligation to compensate you.
5. Privacy
a. The Church is committed to protecting your privacy. The collection, use, and disclosure of personal information through the App are governed by our Privacy Policy, which is incorporated by reference into these Terms.
b. Please review our Privacy Policy for information about your privacy choices, account deletion, and how to contact us about your personal information.
c. The app can display external video embeds and open third-party websites, including Tithe.ly for donations. Those services have their own terms and privacy policies. Giving does not unlock app features or community content.
6. Limitation of Liability
a. To the fullest extent permitted by applicable law, the Church shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use the App or its content, even if advised of the possibility of such damages.
7. Indemnification
You agree to indemnify, defend, and hold harmless the Church, its officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of others.
8.Modifications to the Terms
The Church reserves the right to modify these Terms at any time without prior notice. The modified Terms will be effective immediately upon posting. Your continued use of the App after any modifications to the Terms constitutes your acceptance of the modified Terms.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or in connection with these Terms shall be brought exclusively in the state or federal courts located within the State of California.
10. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
11. Entire Agreement
These Terms constitute the entire agreement between you and the Church regarding your use of the App and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and the Church.
